1. Acceptance of Terms

By accessing and using Practice Deine German ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms & Conditions, please do not use the Service.

2. Description of Service

Practice Deine German provides online German language exam preparation tools, including:

  • B1 exam practice modules (Reading, Writing, Listening, Speaking)
  • Full exam simulations
  • Writing evaluation services (premium feature)
  • Progress tracking and performance analytics

3. User Accounts

3.1 Registration: You may register for an account using email/password or third-party authentication (Google, Facebook).

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials.

3.3 Account Termination: We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscription Plans & Payments

4.1 Free Access: Basic practice modules are available to all registered users at no cost.

4.2 Premium Plans (One-Time Payment): We offer paid one-time access plans with enhanced features:

  • B1 Essentials: €12.99 - 30-day access to all exam modules (Reading, Listening, Speaking)
  • B1 Complete: €29.99 - 30-day access to all exam modules + 10 writing evaluation credits

⚠️ Important:

  • This is a ONE-TIME PAYMENT for time-limited access
  • Access is valid for exactly 30 days from purchase
  • NO automatic renewal - your plan expires after 30 days
  • Access begins immediately upon successful payment
  • You must purchase again after expiration if you wish to continue

4.3 Payment Processing: All payments are processed securely through Stripe. We do not store your payment card information.

4.4 Prices: All prices are displayed in Euros (EUR) and include applicable VAT. Prices are subject to change, but any change will not affect purchases already made.

4.5 Invoice: You will receive a Stripe-generated invoice via email after successful payment. This invoice is legally valid for tax purposes in Germany and the EU.

5. Withdrawal Right & Refund Policy (Widerrufsbelehrung)

Right of Withdrawal

Under EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the purchase.

Loss of Withdrawal Right for Digital Content

By completing your purchase and clicking "Confirm Payment", you expressly agree that:

  • Your premium access begins immediately upon successful payment
  • You are requesting immediate access to digital content
  • You explicitly waive your 14-day withdrawal right as the service begins immediately
  • You acknowledge that you lose your right to withdraw once access has been granted

This is in accordance with Article 16(m) of the EU Consumer Rights Directive, which states that the right of withdrawal does not apply to digital content supplied immediately with the consumer's prior express consent and acknowledgement of loss of withdrawal right.

No Refunds After Access

Once your premium access has been activated (which happens immediately after payment), all sales are final and NO refunds will be provided. This includes cases where you do not use the full 30-day access period.

6. User Content

6.1 Writing Submissions: You retain ownership of any writing you submit for evaluation.

6.2 License to Use: By submitting content, you grant us a license to store, process, and analyze your submissions to provide feedback.

6.3 Prohibited Content: You may not submit content that is illegal, offensive, or violates third-party rights.

7. Acceptable Use

You agree NOT to:

  • Share your account credentials with others
  • Attempt to access other users' accounts or data
  • Use automated systems (bots) to access the Service
  • Copy, reproduce, or redistribute exam content without permission
  • Reverse engineer or attempt to extract source code
  • Use the Service for any illegal or unauthorized purpose

8. Intellectual Property

8.1 Ownership: All exam content, questions, materials, and software are owned by Practice Deine German or licensed to us.

8.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial exam preparation purposes.

9. Disclaimers & No Guarantee of Exam Success

9.1 No Guarantee of Results: Practice Deine German is an exam preparation service. We do NOT guarantee that using our Service will result in passing the B1 German exam. Your success depends on many factors including your effort, study time, existing language skills, and the specific requirements of your exam provider.

9.2 Educational Tool Only: Our materials are designed to help you prepare, but they do not constitute the official exam and may not reflect the exact format, difficulty, or content of the actual B1 exam.

9.3 Not Official Exam Body: Practice Deine German is an independent exam preparation service and is not affiliated with, endorsed by, or associated with Goethe-Institut, telc, ÖSD, or any official German language certification body.

9.4 "As Is" Service: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by German and EU law:

  • No Liability for Exam Failure: We are not liable if you do not pass your B1 exam after using our Service
  • No Indirect Damages: We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • No Lost Profits: We are not liable for any loss of profits, revenues, data, or business opportunities
  • Maximum Liability: Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days preceding the claim

Exception: Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under German law.

11. Privacy & Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

12. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms & Conditions or is harmful to other users, us, or third parties, or for any other reason.

14. Governing Law & Jurisdiction

14.1 Governing Law: These Terms & Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.

14.2 Jurisdiction: Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.

14.3 Consumer Rights: If you are a consumer in the EU, nothing in these Terms affects your mandatory consumer rights under EU law.
